Comply with Italian workplace health and safety rules for posted workers
Italian health and safety framework (Testo Unico Sicurezza).
Documento di Valutazione dei Rischi (DVR) and risk analysis.
Worker training and safety information in Italian.
Italian workplace health and safety is governed by D.Lgs. 81/2008 (Testo Unico sulla Salute e Sicurezza sul Lavoro). The law applies to all workers in Italy, including posted workers. The employer with operational control over the work (often the host company in Italy, but sometimes the sending employer) has obligations: risk assessment (Documento di Valutazione dei Rischi—DVR), appointment of safety roles (RSPP, RLS, medico competente where required), worker training and information, and provision of personal protective equipment (PPE).
For posted workers, responsibility can be shared between the sending and host employer. The EU Directive on health and safety at work requires coordination. We help you understand who bears which obligations, ensure the host site has the required DVR and safety documentation, and that posted workers receive appropriate training and information (including in a language they understand). We advise on the interface between sending and host, and on compliance with Italian rules to avoid sanctions and protect workers.
Key elements of health and safety compliance
Documento di Valutazione dei Rischi (risk assessment document).
RSPP, RLS, medico competente as required.
General and specific risk training for workers.
Personal protective equipment when required.
Clarify responsibilities between employers.
Safety information in a language workers understand.
Common questions about health and safety
Both the sending and host employer can have obligations. The host typically has the DVR and site-specific measures. The sending employer must ensure workers are trained and informed. Coordination is key.
The Documento di Valutazione dei Rischi is the employer's risk assessment document. It identifies hazards and measures to mitigate them. The host employer usually holds it for the work site.
Workers must receive information in a language they understand. For posted workers, this may be their native language. We advise on bilingual or translated materials when needed.
D.Lgs. 81/2008 provides for administrative and criminal sanctions for serious breaches. Proper compliance protects workers and avoids liability.
